IMPORTANT NOTICE
These terms and conditions and promotion rules contain certain terms and conditions which:
• may limit the risk or liability of the Promoter (Ackermans, a division of Pepkor Trading (Pty) Ltd) or a third party; and/or
• may create risk or liability for the entrant; and/or
• may compel the entrant to indemnify the promoter or a third party; and/or
• serves as an acknowledgement, by the entrant, of a fact.
The entrant’s attention is drawn to these terms and conditions because they are important and should be carefully noted.
Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“the CPA”).
The entrant acknowledges that by submitting his or her entry to the promotion he/she has been given an appropriate opportunity to first read these terms and conditions before entering and then he/she understands and agrees to the terms and conditions.
All entrants to this promotion participate entirely at their own risk. The winners accept that there may be a risk of injury due to the energetic nature of the trolley dash and indemnify the Promoter against any liability in this regard.
By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the Promoter; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
Terms and Conditions of the “Shop and stand a chance to WIN a Trolley Dash” Competition
1. The name of the competition is “Shop and stand a chance to WIN a Trolley Dash” (the Competition”).
2. The Promoter of the Competition is Ackermans, a division of Pepkor Trading (Pty) Ltd (“the Promoter”).
3. The Competition will run from 1 August 2024 until 30 September 2024 (both days included) (“the Competition Period”)
4. Participants stand a chance to win 1 (one) of 6 (six) 2-minute Trolley Dashes at an Ackermans store with a trolley value limited to maximum value of R 10 000.00 (ten thousand rand).
5. To enter the Competition and stand a chance to win participants must do the following during the Competition Period:
1. Non-Ackermans account holders – Open an Ackermans account and make a purchase of any value on the account during the Competition Period at any Ackermans store in South Africa and follow the Competition prompts to enter after dialling *130*602#; or
2. Existing Ackermans account holders – Make a purchase of any value on your Ackermans account during the Competition Period at any Ackermans store in South Africa and follow the Competition prompts to enter after dialling *130*602#.
6. 6 (six) winners will be randomly selected by a computer generated draw as follows:
1. 1 (one) winner will be selected on 14 August 2024;
2. 1 (one) winner will be selected on 28 August 2024;
3. 1 (one) winner will be selected on 11 September 2024; and
4. 3 (three) winners will be selected on 01 October 2024.
7. Entry is free and participants may enter multiple times. Participants may only win a prize in the Competition once.
8. Each winner will be allowed to fill their trolley with merchandise for 2 (two) minutes subject to the below:
1. Winners whose trolley value exceeds R10 000.00 (ten thousand rand) will have the option to pay in the balance of the value for the items selected or forfeit items in excess of R 10 000.00;
2. Winners competing in the Trolley Dash who do not shop up to the maximum value of R10000.00 (ten thousand rand) will not be allowed the option to take more items or be entitled to the maximum value of R10000.00 (ten thousand rand);
3. Winners participating in the Trolley Dash will be allowed to select merchandise within the baby, girls, boys and women’s departments;
4. Winners participating in the Trolley Dash will not be allowed to select any cellular devices, hardware (DStv decoders, OVHD Decoders, remotes etc.), technical accessories (earphones, headphones etc.) or use any services e.g. Money Transfers.
9. By entering the competition and/or accepting any prize (if you are a winner), entrants agree to be bound by these terms and conditions.
10. The competition is open to all participants within South Africa only.
11. The Promoter reserves the right to exclude a participant from this Competition or to withhold fulfilment of the prize to a winner should the Promoter become aware that a participant is:
1. a director, member, business partner, employee, agent or consultant of the Pepkor group of companies, its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the Competition.
2. a spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the persons specified in 11.1 above.
12. Ackermans reserves the right to disqualify any participant who enters using false information or enters by robotic, automated or like means.
13. All prizes in the Competition are not transferable and not exchangeable for cash. Winners may return or exchange items selected during the Trolley Dash at any time for items of the same or lesser value but will not be eligible for a cash refund.
14. Winners will be contacted using the cell phone number on record for their Ackermans account. The same number will also be used to send Competition entry confirmation. If a winner cannot be reached after 3 (three) attempted telephone calls at reasonable intervals within 3 business days, an alternative winner will be drawn.
15. Ackermans reserves the right, in their sole discretion, to select the stores where the Trolley Dashes will take place which will be within the provincial metro in proximity of the winner selected.
16. Should a winner not be able or willing to do the Trolley Dash, such winner will have the right to nominate someone who will perform the Trolley Dash on their behalf, or alternatively, such winner will have the right to forfeit participation in the Trolley Dash and receive a R2000 (two thousand rand) Ackermans virtual voucher instead.
17. Winners or their representatives, agree to sign an indemnity form before participation in the Trolley Dash, failing which the winners or their representatives will not be allowed to participate in the Trolley Dash and will receive a R2000 (two thousand rand) Ackermans virtual voucher instead.
18. Winners or their representative will be responsible for their own travel expense to and from the store and need to ensure they are at the store at the arranged date and time.
19. Ackermans and their delivery agent do not accept responsibility or liability for any loss or damage and will also not be responsible or liable for any further expenses or fees required for the purpose of using, applying, participating or enjoying the prize won in this Competition.
20. Winners will be required to give Ackermans and its authorised agents consent to use their names, photos and video footage taken for publicity purposes for the Competition which includes the announcement of the winners on Ackermans’ social media platforms, unless refused, in which event winners will be entitled to nominate someone instore (who is not an employee) to perform the Trolley Dash on their behalf, failing which the winners or their representatives will not be allowed to participate in the Trolley Dash and will receive a R2000 (two thousand rand) Ackermans virtual voucher instead.
21. Ackermans reserves the right to vary, suspend, postpone or terminate the competition and any prizes, or any aspect thereof, for any reasons whatsoever and without notice. In such event, you hereby waive any rights or expectations which you may have against Ackermans and acknowledge that you will not have any recourse or claim of any nature against Ackermans.
22. Your privacy is very important to Ackermans and the Pepkor group of companies (https://www.pepkor.co.za/retail-segments/) and it will use all reasonable efforts in order to ensure that any information, including personal information, provided by you, or which is collected from you, is stored in a secure manner.
