Terms and Conditions - “A+ Win a Car” Competition
1. The promoters of the competition are Ackermans and Tenacity Financial Services, divisions of Pepkor Trading (Pty) Ltd ("the Promoter").
2. The name of the Competition is “Aplus Win a Car” (“the Competition").
3. The Competition will run from 1 December 2024 to 31 December 2024 (both days included) ("the Competition Period").
4. By entering the Competition, all participants and winners agree to be bound by these terms and conditions which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
5. Participants stand a chance to win 1 (one) x 2024 Polo Vivo Hatch 1.4 (Manual) car to the value of R266 600, based on Volkswagen South Africa's recommended retail price ("the Vehicle prize”). The colour of the actual car may vary from the colour as displayed in our marketing material. The colour selection will be based on the colour available at time of the Vehicle prize handover.
6. The Competition is open to all participants 18 (eighteen) years or older at the time of entering the competition within the Republic of South Africa that are South African citizens (in possession of a valid South African ID book or card) and South African residents (in possession of a valid South African permanent residency permit).
7. You must possess a valid South African driver's licence to claim the Vehicle prize.
8. You are not eligible to participate in this competition if: -
a. You are a director, member, partner, employee, agent or consultant of Ackermans and its affiliates/divisions/subsidiaries or any other person who supplies goods or services in connection with the competition;
b. You are a spouse, life partner, parent, child or sibling, immediate family member, business partner or associate of the persons specified above.
9. To enter the Competition participants will need to do the following during the Competition Period to qualify for an automatic entry to the Competition (“Participants”):
a. Non-Ackermans account holders - Open an Ackermans account and make a purchase of any value at any Ackermans store in the Republic of South Africa on your Ackermans account; or
b. Existing Ackermans account holders - Make a purchase of any value at any Ackermans store in the Republic of South Africa on your Ackermans account;
10. Entry into the competition is free and participants may enter multiple times during the competition period, provided that participants complete the Competition entry steps set out in clause 9 above.
11. One (1) winner will be randomly selected via a computer operated draw on 6 January 2025 from Participants.
12. 20XX Polo Vivo Hatch Trendline 1.4 (Manual)
a. To claim the Vehicle prize, the winner must produce their valid South African driver's licence as well as a South African identity document.
b. If the possible Prize winner passes the verification process and submits the required documents stipulated in these terms and conditions they will be declared a winner by the Promoters. The validity of such documentation is at the Promoter’s discretion.
c. Should the winner not be in possession of a valid South African driver’s licence, that winner will be disqualified, and the Promoter will choose another winner from the participants.
d. The winner of the Prize will have to collect the Vehicle prize at a selected Volkswagen South Africa dealership or Volkswagen accredited dealership or partner in South Africa.
e. The Promoter will advise the winner when the Prize will be ready for collection. Once the winner has been notified of a suitable handover date, the winner will need to collect the Prize within 21 (twenty one) business days of the handover date being confirmed.
f. If the winner does not collect the Prize within 21 (twenty one) business days and does not provide an updated expected collection date and time, then the winner will forfeit the Prize, and the Promoter will move onto the next possible winner.
g. The Prize cannot be exchanged for any other model or make within the vehicle range and the winner does not have the right to change the specifications of the vehicle.
h. The Vehicle prize does not include insurance on the vehicle and the winner is liable for any associated costs in taking ownership of the vehicle.
i. The Vehicle prize does not include any extras such as fuel and additional accessories.
j. The Promoters reserve the right to change the vehicle model to another vehicle at the same value, if the vehicle advertised is no longer available.
k. No liability shall attach to the Promoters in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the prizes. The Promoters are not liable for any defects in the prizes. Ownership of and risk in, and benefit attaching to, the prizes will pass to the winner immediately.
l. All prizes are awarded at the discretion of the Promoters. The Promoters reserve the right, at its own discretion, to substitute a prize with any other prize of comparable commercial value or an appropriate replacement value in the place of the prize.
m. The Prize can only be awarded to the winning participant that has not won in any competition organised by the Promoters within the last 6 (six) months.
13. In addition to any other the verification requirements set out in these terms and conditions, the Promoter may require the Prize winner to complete and submit an information disclosure agreement and indemnification, as well as supply a certified copy of their valid South African ID or Passport with their endorsed residence permit within 24 (twenty four) hours of being confirmed a winner, to enable the Promoters to ensure compliance with these terms and conditions and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this for any reason, such winner will be deemed to have rejected the prize and it shall revert back to the Promoter.
14. The Promoters reserve the right to disqualify any entrant who enters using false information by robotic, automated or like means.
15. The Prize in this Competition is neither transferable nor redeemable for cash and the Promoters are not liable for any defect in the prizes.
16. Possible winners will be contacted between 10am and 3pm on the day of the random draw on the cellphone number used to enter the Competition. Calls may be recorded for verification purposes.
17. The Promoter will endeavour to contact the prize winner once every day for 2 consecutive working days after their name is drawn. If the prize winner cannot be contacted during this period for whatever reason including technical problems, the prize will be forfeited.
18. Winners have 7 (seven) working days from being contacted to submit their details for verification to claim the Prize.
19. The Promoters and their delivery agent does not accept responsibility or liability for any loss or damage and will also not be responsible or liable for any further expenses or fees required for the purpose of using, applying or enjoying the prize won in this competition.
20. Winners give the Promoters and its authorised agents consent to use their images for publicity purposes, unless refused.
21. The Promoters reserve the right to vary, suspend, postpone or terminate the competition and any prizes, or any aspect thereof, for any reasons whatsoever and without notice. In such event, you hereby waive any rights or expectations which you may have against the Promoters and acknowledge that you will not have any recourse or claim of any nature against them.
22. By participating in this competition, you consent to (i) the processing of your personal information by the Promoters and other companies in the Pepkor group of companies (www.pepkor.co.za), any of their operators, agents and sub-contractors (who may be outside South Africa) on the condition that they will keep such information confidential; (ii) the collection of your personal information from any other source to supplement the personal information which the Promoters have about you; (iii) the retention by the Promoters of your personal information for as long as permitted for legal, regulatory, fraud prevention and marketing purposes; (iv) The Promoters using your personal information to send you information about products, services, and special offers of the various companies in the Pepkor group that may be of interest or value to you.
23. You can choose to be excluded from direct marketing by notifying the Promoters in writing or by registering a block on any registry which the Promoters is bound by law to recognise. The Promoters will not charge you a fee to update this request on its systems and will give effect to any changes requested by you as soon as reasonably possible.
